Main Purpose Statement

The primary purpose of this role is to ensure that RCS is protected, compliant and current across all legal relationships in order to manage and mitigate risk. The incumbent will support the Legal team in order to ensure that RCS staff and business stakeholders are given the necessary support and assistance in respect of relevant legislative, internal policy and regulatory obligations and best practice standards. 

Key Responsibilities

  • Timeous and accurate drafting, vetting and updating of legal documentation, such as contracts and correspondence
  • Providing legal advice to internal stakeholders on applicable legislation, including but not limited to the National Credit Act, relevant Insurance legislation, Debt Collectors’ Act and Protection of Personal Information Act
  • Management of regulatory watch process through research and reporting on legal developments relevant to RCS. This includes proactively monitoring, researching, and reporting on legislative and industry developments relevant to RCS, ensuring the company remains compliant and informed
  • Managing legal risk in accordance with the RCS legal and operational risk control frameworks, including incident logging and participation in relevant meetings.
  • OPC for the Legal Department – this entails working with management and ORC to ensure risk management complies with the Operational Risk Control framework (including logging of historical incidents and attendance at meetings)
  • Regulatory Watch Officer for the legal department
  • Attending training seminars and workshops on legal topics relevant to RCS and implementing best practice at RCS
  • Developing and delivering legal training and education programs for RCS staff to foster a culture of compliance and best practice.
  • Assisting with internal reporting, shareholder management and ad hoc audits
  • Management of functional projects
  • Assisting business areas with contracts administration and management
  • Represent the Legal department at relevant forums, committees and meetings
  • Engage with Regulator channels such as CIPC and the Information Regulator.
  • Company Secretarial (as required)
  • Support to the Company Secretarial function for the Company
  • Drafting resolutions (sign-off, oversight and execution)
  • Manage resolutions register
  • Attend to ad hoc resolution queries
  • Keep abreast of developments in good governance, Companies Act, King III, etc.

Qualifications, Skills and Experience

  • Admitted Attorney
  • Good understanding of South African laws
  • Minimum of 2 years post qualification working experience
  • Previous experience in financial services industry - advantageous
