BNP Paribas Corporate & Institutional Banking provides large companies, multinationals and financial institutions with various solutions in the areas of advisory, financing, transactional banking, capital markets, settlement, clearing and custody of securities, asset and fund management services and solutions for corporate issuers. It has 620 professionals in Spain with offices in Madrid, Barcelona, Bilbao and Coruña. The entity has a network present in 56 countries.
KEY RESPONSIBILITIES
TP and CIT support to all business lines/entities/functions
- Individual annual TP reports and Master File preparation in coordination with the external tax advisors and GTD Paris.
- Coordination with the local group entities to prepare TP reports, individual and Master File.
- Valuation policy and group operations/services treatment by the entities/business lines/functions and GTD Paris.
- Restructuring operations supervision, such as contributions of branch of activity, mergers, transfers of activity, etc.
- Booking policy in intragroup operations such as financing RPAs and transnational share business agreements related to.
- Review CIT and TP criterion applied in SLAs.
- Individual CIT returns preparation support.
- Coordination within the different entities/departments in order to prepare the consolidated CIT returns, with new entities joining the groups, entities´ exit, restructuring operations, etc.
- Analysis of regulatory changes in CIT and TP and adaption to the group in Spain, in communication with the different finance areas.
- Specific analysis required by GTD France, on Spanish regulation (CIT and TP).
Internal and external reporting support to all business lines/entities/functions
- Preparation of some specific annual reporting obligatoins at the level of the group or individual reporting obligations not assumed by finance, such as CbC, 181, 345, Pilar II, FATCA/AEOI reporting, DAC6, etc.
- Support to local finance and to the operations departments, on the reporting to the TA, based on regulatory changes, tax treatments, etc
- Support on QI and FATCA specific reporting issues.
The tax function is the “local coordinator” in respect to FATCA/AEOI reporting, with the aim of review and control that all the participants in the local reporting confirm the data.
- Internal proceeding preparation related to the Tax Function and follow up.
- Tax Function Generic Control Plan preparation and follow up.
- Tax Function controls preparation and follow up.
- Communications/notifications/requirements control, received from the TA and coordination with the related departments in order to prepare and monitoring the answers.
- Preparation of claims before the TA or the Courts with regard to any tax aspects (local or Regional taxes, State taxes, etc.).
- Regular reporting to GTD Paris (tax risk, new operations, etc) in order to perform the direct reporting to the functional management.
- Tax on activities control over all the activities of the group in Spain, including the participation in the specific committees and dedicated meetings.
- Tax audit point of contact. Monitoring and follow up of tax audits.
Support on non resident clients´ “tax reclaim” service and management of tax certificates
- Support on any issue related to the “tax reclaim” services provided to clients.
- Support to the custodian with regard to any change in the non resident regulation or in the Conventions to avoid double taxation.
- Management of certifications for the group entities, (tax residency; FATCA; QI; or other)
- Electronic tax certificates management, request and uploading when necessary with their corresponding legal procedure.
General support to business lines and functions on their activities
- Support to hhrr in order to obtain the necessary certifications for employees applying the special tax regime of Art.93 of the PIT and other support functions in relation to tax treatment and formalities for transferred employees.
- Support to finance departments in any issue related to VAT, invoicing or other issues.
- Monitoring changes of tax legislation impacting any area in the group.
- Inform of relevant tax changes to the functions and business lines.
SKILLS REQUIRED
- Comprehensive knowledge of taxation,
- Demonstrated ability to think strategically with the management of tax litigation;
- Presentation skills and ability to explain tax changes and adaptations to the operational teams and in general to the business, functions, etc
- Ability to work with tight deadlines;
- Experience in accounting and annual financial statements review;
- Experience in financial sector;
- Ability to work in team and also independently changing every day the issues to treat;
- Understanding of reporting processes and technical requirements
